Terms And Conditions For The Provision Of Services
By using all of our services, you agree to these terms and conditions of service. If You are not satisfied with these terms and conditions, You have the option to stop using Our services. The terms and conditions contained in the service agreements we enter into shall prevail over these terms of service. We have the right to modify or amend these terms and conditions without prior notice. By using Our services, You agree to the most up-to-date terms of service as set out in this mobile application/website.
TERMS
The Account Information Service Provider is Enable Banking Oy, legal entity number 2988499-7, address Otakaari 5, Espoo, Republic of Finland, supervised by FI - Finnish Financial Supervisory Authority.
User, You - the person who uses the services provided by UAB DALINK.
Services - by using Our website or mobile application, You are given the opportunity to purchase goods and services of Our partners at a discount specified and applied by Our partners and to allocate the accumulated discount points to the desired charity organisation.
Account Information Service, SIP - a payment service where consolidated information about one or more payment accounts held by the payer with another payment service provider is provided online.
Terms and conditions means the rules for the provision of these services.
DALINK, UAB, We - means UAB DALINK, legal entity code 306318404, address Jogailos g. 4 Vilnius, Lithuania.
GENERAL PROVISIONS
1. The User accepts the Terms and conditions by reading them and by ticking the box next to the statement „I have read and agree to the Terms and conditions of provided services“.
2. In the event of changes in market conditions or in the circumstances provided for by the legislation of the Republic of Lithuania, We shall have the right to change, amend or supplement the terms and conditions. Users will be informed of this by logging into their account on the mobile application or on the website www.donafy.lt.
3. The User must familiarise themselves with Our approved and publicly available Privacy Policy. The User‘s personal data will also be transferred to the Account Information Service Provider and such personal data will be processed in accordance with the contractual security obligations between Us and the Account Information Service Provider with respect to the security of personal data.
4. By accepting the Terms and conditions, You acknowledge that You will be responsible for Your internet connection and all equipment necessary to use the Services.
5. Users of the Services are responsible for the security of their username and password. Users are responsible for any actions taken after logging in with a personal password to Our website or mobile application.
6. You take full responsibility for the accuracy and reliability of the information and data provided.
7. You are fully responsible for all activities on your account. In the event of any unauthorised access to Your account, please notify Us immediately. You acknowledge that We or the Account Information Service Provider will not be liable for any loss or liability suffered by You if someone uses Your Account with or without Your knowledge.
8. You will be liable for any damages We or the Account Information Service Provider suffer as a result of activity on Your Account.
9. Users are not charged a commission for the provision of SIP.
10. The User shall be given clear and unambiguous information prior to the commencement of the SIP service that the Account Information Service Provider, and not We, will provide the SIP service. You release Us from all liability in connection with the provision of the SIP services. You acknowledge that you have the right to provide Us with your username, IP address, password, email address, mobile phone number, personal identification number and other login information.
11. The User, having consented to the provision of the SIP and having provided Us with his/her personal data, connects to his/her payment service provider. In performing this function, We do not collect or store e-banking data (personalised security data) provided by the User. The information used by the User to log in to electronic banking (customer identification code, password, generator codes, password card codes, etc.) is encrypted and used only for one-time account information and only during one session.
12. The SIP shall provide Us with information about the account(s) held by the User with a particular payment service provider and the transactions carried out on that account(s).
13. We own all intellectual property relating to the URLs, materials, products, content, design, layout, photographs, text, tools and software for the provision of services on the Website and the Mobile App, other than Your data and information that You provide to Us in connection with Our services.
14. We may terminate the Services at any time without notice to You, including, without limitation, if You violate these Terms and conditions.
15. Our Privacy Policy is an integral part of these Terms and conditions. The Privacy Policy is based on applicable law and is subject to change or amendment.
RESPONSIBILITY
16. The User shall be liable for any unlawful acts committed while using Our services.
17. If the UAB DALINK mobile application or website contains links to other third party websites, We do not warrant that the information that can be viewed by clicking on these links is correct, complete or accurate. The content, correctness, completeness and accuracy of the information provided by third parties is the responsibility of the third parties.
18. Users agree to indemnify and hold harmless UAB DALINK from and against any and all damages, losses, claims or liabilities of any kind arising out of the use of the services provided by Us in accordance with these Terms and conditions.
DATA PROTECTION
19. For the purpose of providing SIP services, the following data (including personal data) may be processed: the User‘s name and surname, personal identification number, date of payment, amount of the payment, purpose of the payment, email address, IP address, list of the User‘s accounts and the User‘s balance, the User‘s account number.
20. We process Users data in accordance with the following provisions: (i) we ensure that User information obtained through the provision of the services is processed only to the extent and for the periods necessary to provide the services or as required by law, (ii) we ensure that User‘s personalised security data is not accessible to other parties, (iii) we do not collect or process the data for purposes unrelated to the provision of the services, (iv) we implement appropriate organisational and technical measures to protect personal data from accidental or unlawful destruction, alteration, disclosure.
21. The User has the right to access his/her personal data processed by Us. UAB DALINK, upon receipt of a written request from the User for access to his/her personal data processed, shall provide the requested data in writing within the time limit set by law or shall state the reasons for refusal to comply with such request. Data may be provided free of charge once per calendar year, but in other cases a fee may be charged for the provision of data.
22. The user has the right to request the termination of the processing of his/her personal data (erasure of data) if the personal data are no longer necessary for the purpose for which they were obtained.
23. The User‘s personal data shall be processed and stored for six months from the date of receipt until it is deleted or updated by the User.
FINAL PROVISIONS
24. These Terms and conditions shall be governed by the law of the Republic of Lithuania.
25. The User shall have the right to lodge complaints or claims regarding the services provided, by sending a general email to info@donafy.lt. A written complaint shall be investigated no later than 10 working days from the date of receipt of the complaint.
26. We reserve the right to unilaterally change these Terms and conditions at any time and such changes shall take effect upon posting on Our mobile application or website.
